Practice Summary
Diane Brazen Gordon has twenty years of experience concentrating in business and consumer bankruptcy
law and civil litigation. Diane represents debtors in both chapter 7 and chapter 13 consumer and business
bankruptcy cases under chapter 7, 11 and 13 of the Bankruptcy Code. She also represents trustees both at Lakelaw and other
firms in connection with a wide variety of litigation. She has extensive experience in the representation of creditors'
committees in chapter 11 cases, and condominium associations in bankruptcy related matters. Now, in response to the mortgage
lending crisis, Diane is defending people against predatory mortgage loans and abusive mortgage servicing practices. Diane
remains active in the Skokie community where she was born and raised and is particularly concerned about economic conditions and
challenges facing its business districts in transition.
Representative Matters
- complaint for chapter 7 trustee against bank to avoid preferential transfers
- successful claim against lawyers, escrow officers, intermediaries and others involved in mortgage rescue and equity stripping scheme on behalf of chapter 7 trustees resulting in payment in full to unsecured creditors
- litigation against mortgage broker under Illinois Consumer Fraud and Deceptive Business Practices Act and for common law fraud in connection with predatory lending practices
- complex chapter 13 debtor adjustment cases
- primary responsibility for the successful resolution of several lawsuits on behalf of individuals for personal injuries and employment discrimination, including a trial in federal court as co-counsel with the Equal Employment Opportunity Commission
- Represented debtors and creditors in Chapter 11 business reorganizations, including participation on a creditors’ committee.
