Jonathan T. Brand

Practice Summary

Jonathan Brand is a resident of Lakelaw's Chicago office. He represents Chapter 11 debtors, Chapter 7 trustees, and creditors in a variety of insolvency proceedings pending in State and Federal Bankruptcy Court. He has also prosecuted and defended a significant number of adversary proceedings pending in Bankruptcy Courts throughout the country. Through his practice, Jonathan has handled a wide range of matters in the construction, manufacturing, real estate, equipment leasing and pharmaceutical industries.

His recent successes include the representation of small business debtors, real estate developers, and single asset real estate entities before the Bankruptcy Court. Additionally, he has represented numerous real estate developers in real estate “work-outs” and out-of-court restructurings.

Recently, Jonathan was selected by Illinois Super Lawyers as a "Rising Star". This distinction is awarded to just 2.5% of attorneys under the age of 40 in Illinois, and is the result of a peer nomination and review process.

  • In re Denham Homes, LLC -- After a successful confirmation trial, settled all disputes with senior secured creditor and confirmed a chapter 11 plan of reorganization.
  • In re Pasquinelli Homebuilders, Inc. -- Represented insurance company in its efforts to move forward with state court contribution and subrogation claims against third parties
  • Represented High-Net Worth Individual in an out-of-court workout with mortgage lender.
  • In re Smith-Rothchild Financial Company -- Represented chapter 7 trustee in connection with a section 363 auction sale of approximately 50 parcels of real property and 40 consumer credit transactions.
  • In re Ty Miles Incorporated – Small business chapter 11 case. Successfully defended secured creditor’s motion to dismiss and reached a consensual, confirmed chapter 11 plan of reorganization.
  • In re Patrick Power Corp. – Preference defense. Defense of preference claims asserted by chapter 7 trustee on the grounds of ordinary course of business and new value defenses.
  • In re Purity Products, Inc. – Preference defense. Defense of chapter 7 trustee’s preference claims.
  • In re Global Estates, LLC (and related subsidiaries) – Representation of commercial landlord in chapter 11 case concerning 10 different properties.
  • In re Premier International Holdings, Inc. (aka Six Flags, Inc.) – Representation of governmental entity in debtor’s chapter 11 case.
  • Representation of Individual Chapter 11 Debtor – Assisted individual with significant real estate holdings in and out of chapter 11 bankruptcy process.
  • Representation of Various Single Asset Real Estate Entities with their restructuring and insolvency issues in chapter 11 cases and in workout negotiations.
  • Representing real estate developer in its Chapter 11 case and contested confirmation hearing.
