Jonathan T. Brand
Practice Summary
Jonathan Brand is a senior associate located in Lakelaw's Chicago office. He represents debtors, trustees, and creditors in a variety of commercial or complex insolvency proceedings pending in state and federal courts. Jonathan is board certified in Business Bankruptcy by the American Board of Certification. Through his practice, Jonathan has handled a wide range of matters in the construction, manufacturing, real estate, and equipment leasing industries. He has significant experience prosecuting and defending adversary proceedings pending in Bankruptcy Courts throughout the country.
Jonathan regularly represents real estate developers, governmental entities, commercial landlords, small business debtors, and single asset real estate entities before the bankruptcy court. He also represents business owners, developers and commercial property owners in “work-outs” and out-of-court restructurings.
Jonathan is a member of the Liaison Committee for the Bankruptcy Court of the Northern District of Illinois. He also enjoys giving back to the community. Jonathan represents pro bono clients through the Bankruptcy Court’s Volunteer Attorney Panel, and volunteers with the American Bankruptcy Institute’s Credit Abuse Resistance Education (C.A.R.E.) Program.
Jonathan has been Peer Review Rated as AV® Preeminent™, the highest performance rating in Martindale-Hubbell's peer review rating system. Illinois Super Lawyers also recognized Jonathan as a "Rising Star" for 2012. - Represented High-Net Worth Individual in an out-of-court workout with mortgage lender.
- In re Smith-Rothchild Financial Company -- Represented chapter 7 trustee in connection with a section 363 auction sale of approximately 50 parcels of real property and 40 consumer credit transactions.
- In re Ty Miles Incorporated – Small business chapter 11 case. Successfully defended secured creditor’s motion to dismiss and reached a consensual, confirmed chapter 11 plan of reorganization.
- In re Patrick Power Corp. – Preference defense. Defense of preference claims asserted by chapter 7 trustee on the grounds of ordinary course of business and new value defenses.
- In re Purity Products, Inc. – Preference defense. Defense of chapter 7 trustee’s preference claims.
- In re Global Estates, LLC (and related subsidiaries) – Representation of commercial landlord in chapter 11 case concerning 10 different properties.
- In re Premier International Holdings, Inc. (aka Six Flags, Inc.) – Representation of governmental entity in debtor’s chapter 11 case.
- Representation of Individual Chapter 11 Debtor – Assisted individual with significant real estate holdings in and out of chapter 11 bankruptcy process.
