Many of the foreclosures that have recently begun to plague homeowners in Illinois, Wisconsin and around the country could have been prevented. Since 2003, we have been studying strategies for turning the tables on predatory lenders. Since then, many homes have been lost in Chapter 7 bankruptcy proceedings by debtors who assumed that foreclosure is inevitable. But foreclosure is not inevitable. We will always look at all of your mortgage refinancing papers at no additional cost to you. We do not think that this is standard practice among bankruptcy attorneys, but we think that it should be.
There are a number of different laws in place to make sure lenders do not take advantage of borrowers who do not understand their rights, including:

- Real Estate Settlement Procedures Act (RESPA)
- Home Owner's Equity Protection Act (HOEPA)

Mortgage Rescue Scams
Has anyone tried to “help” you save your house by asking you to give them a deed? Have you actually given somebody the deed to your house to “protect it” until you can “buy the house back”?
If so, you have been scammed by Mortgage Rescue Fraud. The Illinois Consumer Fraud and Deceptive Business Practices Act, the federal Home Owners Equity Protection Act and Chapter 100.18 of the Wisconsin Statutes provide very effective tools to fight back against Mortgage Rescue Fraud. We also will not hesitate to ask for jury trials to pursue your claims of common law fraud, fraud in the inducement, misrepresentation, conspiracy to commit fraud, aiding and abetting fraud and numerous other common law claims.
