Trustee and Receivership
Our leaders, Jim McNeilly and David Leibowitz, both have been appointed by the United States Trustee to serve as Chapter 7 trustees. Jim has been serving in this role for over 20 years and David has been a trustee since 1990. During this time, they have overseen at least 20,000 cases.
Furthermore, they have served as trustees in chapter 11 cases and cases converted from Chapter 11 to chapter 7. They have liquidated millions in assets for distribution to creditors.
Jim McNeilly is eligible to serve as a receiver in liquidation proceedings under Chapter 128 and also under Chapter 180 of the Wisconsin Statutes. David Leibowitz is eligible to serve as an assignee in an assignment for the benefit of creditors in Illinois. Both Jim and David are eligible to serve as receivers in state court litigation such as foreclosures, dissolutions of corporations, partnerships and limited liability companies and in equity cases generally. Both Jim and David are eligible to serve as trustees and executors in probate cases as well.
Lakelaw also proudly represents other bankruptcy trustees. Presently, the firm represents at least 5 other chapter 7 trustees, all of whom have selected Lakelaw because of our demonstrated expertise.
We are proud members of the National Association of Bankruptcy Trustees. Jim and David both have been invited to speak at the National Association of Bankruptcy Trustees meetings. David has published in the NABT’s publication NABTalk on more than one occasion. Now, David Leibowitz has written an article on Residential Mortgage Issues in Consumer Bankruptcy Cases to be published in the 2008 Norton’s Annual Survey of Bankruptcy Law.
We have achieved outstanding results in our discharge of fiduciary obligations. We have achieved outstanding results in representing others in the discharge of their obligations as trustees as well. We are proud to have earned their confidence and business.
